2.1 Subject to any variation anticipated in these GTC and different provisions agreed in writing in the Contract, the Contract will be governed by these GTC, to the exclusion of all other terms and conditions and all previous oral or written representations, including any terms or conditions which the Customer purports to apply under any purchase order, confirmation of order or any other similar document. 2.2 Each order or acceptance of a quotation for Products or Services will be deemed to be an offer by the Customer to purchase Products or receive Services upon these Terms and Conditions. In the case of Vehicles, the Contract will come into existence when it is signed by both parties. 2.3 The Company reserves the right to require payment of a deposit as a condition of entering into the Contract or acceptance of an order. 2.4 Unless otherwise specified in writing by the Company , any quotation is valid for a maximum period of 30 days only from its date of issue, provided the Company has not previously withdrawn it. The Company is not obliged to give a quotation before commencing any Service, unless previously requested by the Customer in writing to do so. 3. DESCRIPTION AND TECHNICAL SPECIFICATIONS 3.1 The quantity and description of the Products or Services will be as set out in the Company’s acknowledgement of order or in the Contract. All samples, drawings, brochures, technical specifications and advertising issued by the Company or Volvo and any descriptions or illustrations contained in the Company’s or Volvo’s catalogues or brochures or described on the Company’s or Volvo’s website are issued or published for the sole purpose of giving an approximate idea of the Products or Services represented by or described in them. Such materials will not form part of the Contract and this is not a sale by sample. Without prejudice to the generality of the foregoing, the year attributed to any Vehicle is the year of first registration and not necessarily the year of manufacture. 3.2 The Company may make any change to the technical specification, design, materials or finishes of the Products or provision of the Services which are required t o conform with any applicable safety, statutory or regulatory regulation or do not materially affect their quality or performance. 3.3 The Customer acknowledges that Volvo has a policy of continuous improvement of design, production and technical specification and that Volvo reserves the right to change the design or specification of any Volvo Product at any time without notice, and to fulfil existing orders for new Volvo Vehicles or new Volvo Parts (including orders which have been partially completed) with a Volvo Product of the changed design or technical specification, provided that the Volvo Product so changed meets the requirements of the original order. 3.4 The Company aims to inform the Customer as soon as practicable of any significant changes t o design or technical specification of ordered but not delivered Volvo Products. In the event that the changed design or technical specification does not meet the requirements of the original order , then the Customer shall have the right to cancel the order with the Company within seven days from Delivery. The Company shall not be liable for any losses, damages, costs or expenses whatsoever arising from such cancellation. Special provisions relating to Electric Vehicles 3.5 As the Vehicle is an electric-drive vehicle, any intervention into the vehicle, including emergency services, requires a special and mandatory authorisation , the use of personal protective equipment and the delivery of the Vehicle. All warnings located in the Vehicle, or otherwise provided by the Volvo company, must be complied with, including the labels and instructions stated in the user ’s guide. The user shall comply with such instructions at his own responsibility. A driver and any third person operating the Vehicle must be informed about the functions of an electric Vehicle and related safety instructions. Electrician licences, training and safety warnings are necessary for the use or the Vehicle or for the work with the Vehicle. Only the Customer is responsible for the compatibility of electric systems used for Vehicle charging. Volvo shall bear no responsibility if the Customer fails to complete training, acquire a licence or ensure compliance of the equipment and systems with the applicable laws. For any questions relating to electric safety the Customer should contact a service technician with adequate qualification in this area. The Customer is further aware that ERS guidelines include the following statement: “We recommend the necessary battery capacity based on key information, such as the specifications of the vehicle and chassis, route/cycle of operation which you have provided and the environment, to be able to predict the effective range of the vehicle during its typical lifespan. Several assumptions are made in the calculation, of which the goal is to copy typical use. With all vehicles, the actual range is affected by the circumstances in which the vehicle is used, such as load, route, driving style and weather, use of key electrical systems, such as lights,
